Official Rules
This Sweepstakes is intended for play and participation in the United States only and shall only be construed and evaluated according to the laws of the United States. Please do not enter this Sweepstakes unless you are a legal resident and residing in the 50 United States or the District of Columbia at the time of entry.
Sweepstakes begins 12:00:01 a.m. Central Time (“CT") on 10/29/09, and ends 11:59:59 p.m. CT, on 11/30/09 (“Sweepstakes Period").
1. Eligibility: NO PURCHASE (and additionally for CA residents, NO PAYMENT OF ANY KIND) NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia ages 18 (19 in NE and AL) or older as of 12:00:01 a.m. CT on 10/29/09. Void in Puerto Rico and where prohibited or restricted by law. Employees of 3M, the “Promotional Participants" (i.e., Gage Marketing Group, LLC, and each of their respective agencies, parents, subsidiaries, affiliates, vendors, officers, directors, agents, wholesalers and retailers involved in this sweepstakes), and NASCAR, Inc., and their affiliates and each of their respective employees, shareholders, officers, directors, agents, members, personnel and assigns (collectively, the “Released Parties") and their immediate family members (mother, father, sister, brother, husband, wife, daughter, son, step-father, step-mother, step-daughter, step-son, step-brother, step-sister, half-brother, and half-sister) and/or those living in the same household of each are not eligible.
2. To enter the Sweepstakes. Log on to www.filtrete.com/race and follow the instructions to complete and submit the registration form including your complete first and last name, valid home address (P.O. Boxes are not permitted), city, state, ZIP code, telephone number, email address, and date of birth. Sponsor's computer is the official clock for this Sweepstakes. Limit one (1) entry per person/email address, per day. Proof of registration/submission does not constitute proof of entry.
3. Drawing: Prize winners will be selected in a random drawing held on or about 12/04/09 from all eligible entries received. An independent judging organization, whose decisions are final and binding, will conduct the drawing. All winners will be notified by phone or mail. Odds of winning will depend upon the number of eligible entries received. Limit one (1) Sweepstakes prize per household.
4. Prizes/Approximate Retail Value (ARV): Grand Prize – One (1): a trip for two to a NASCAR® Sprint Cup Series Race in 2010. Prize includes round-trip economy class transportation for two (2), (specific air carrier to be chosen at Sponsor's sole discretion) from a major US airport close to winner's residence to race location, a mid-size rental car for 3days, Recreational Vehicle accommodations for three (3) nights and camping in the race camping area for three (3) nights, (Recreational Vehicle will be stocked with food and non-alcoholic beverages), two (2) Grand Stand tickets to the race and a one-year supply of Filtrete Ultimate Allergen Reduction Filters (awarded in the form of four (4) filters). Not all filter sizes available. ARV: $4,235. (Actual retail value may vary depending on winner's point of departure and airfare fluctuations. Any difference between stated approximate retail value and actual value will not be awarded). Date and location of race to be determined by Sponsor. If potential Grand Prize winner lives within 150 miles of race, a travel stipend of $300 will be awarded in lieu of airfare. Trip must be taken on dates specified by Sponsor or prize will be forfeited in its entirety. All travel-related expenses not set forth herein, including but not limited to meals, luggage fees, gratuities, and incidental and personal expenses are the sole responsibility of the winner. All standard NASCAR® terms and conditions apply to tickets and/or passes. Tickets shall be subject to policies and procedures established by issuer. Seat location at Sponsor's sole discretion. Sponsor is not responsible if any race is delayed, postponed or cancelled for any reason. In the event a race is delayed, postponed or cancelled, ticket portion of prize will be forfeited. First Prizes – Ten (10): A one (1) year supply of Filtrete Ultimate Allergen Reduction Filters (awarded in the form of four (4) filters). Not all filter sizes available. ARV: $75 per first prize. Total ARV of all prizes $4,985.
5. Prize/Winner Verification: No transfer of prize, cash redemption or prize substitution allowed, except as provided herein. In case of unavailability of any prize, Sponsor reserves the right to substitute a prize of equal or greater value. Potential Grand Prize winner and his/her guest must sign and return an Affidavit of Eligibility/ Release of Liability Form within 14 days of attempted notification. Noncompliance within this time period will result in disqualification and an alternate may be selected, time permitting. Return of any prize/prize notification as undeliverable will result in disqualification and an alternate may be selected, time permitting. If guest of Grand Prize winner is a minor (as determined by his/her state of residence) winner must be minor's parent/legal guardian, who will be required to complete paperwork on minor's behalf. Should multiple users of the same e-mail account enter the Sweepstakes and a dispute thereafter arises regarding the identity of the winning entrant, the authorized subscriber of said e-mail account at the time of entry will be considered the entrant. “Authorized account subscriber" is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Winners also consent to the use of their name, voice, and likeness and/or photograph Sponsor, its affiliates, and agents for advertising, publicity and trade purposes without additional compensation, except where prohibited by law. By accepting a prize, winners acknowledge and agree that Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and the employees, officers, directors and agents of each of the above, have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize including but not limited to its quality, mechanical condition, merchantability or fitness for a particular purpose or the home inspection written report's compliance with state or local laws.
6. General: By participating in this promotion, entrants agree to abide by and be bound by these Official Rules and the decisions of the judges, which are final and binding in all matters relating to this promotion. No more than the advertised number of prizes will be awarded. All submitted entries become property of 3M and will not be returned. Participants waive the right to assert as a cost of winning a prize any and all costs of redemption and any liability which might arise from redeeming or seeking to redeem said prize, or from use, misuse, acceptance or possession of said prize. By entering, entrants further agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of State of Minnesota, without giving effect to any choice of law or conflict of law rules (whether of the State of Minnesota or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Minnesota. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Minnesota.
7. Limitations of Liability: Sponsor and other Released Parties are not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software, delay in operation or transmission, communications line failure, technology outage, theft or destruction or unauthorized access to, or alteration of entries, whether caused by the sender or any of the equipment or programming associated with or utilized in the Sweepstakes; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process, (iv) electronic, clerical or human error which may occur in the administration of the sweepstakes or the transmission, receipt or processing of entries or notification of winners; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the sweepstakes. Without limiting the generality of the foregoing, Sponsor reserves the right, in its sole discretion, to terminate, modify, cancel or suspend this sweepstakes if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Sponsor corrupt the administration, security, or proper play, of the sweepstakes. In the event of termination, prizes will be awarded in a manner to be determined by Sponsor consistent with state requirements. Under no circumstances, including negligence, shall the Sponsor or the other Released Parties be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the web site, or out of any breach of any warranty. This exclusion or limitation of liability will not apply to the extent that any applicable statute prohibits such exclusion or limitation of liability. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SPONSOR'S WEB SITE IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ANY WARRANTY, EXPRESS OR IMPLIED, THAT THE HOME INSPECTION WRITTEN REPORT COMPLIES WITH STATE OR LOCAL LAWS, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES; CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS REGARDING THESE LIMITATIONS OR RESTRICTIONS. Any attempt by an entrant or other individual to deliberately damage any web site or undermine the legitimate operation of this promotion, including but not limited to any fraudulent claims, may be a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Participant engaging in any of the foregoing activities may be disqualified and will forfeit any prize won.
8. Winners List: For a list of winners, send a self-addressed, stamped business size #10 envelope by to: Filtrete™ Beat the Dust Sweepstakes Winners List, PO Box 27792, Golden Valley, MN 55427, to be received by 12/07/09. Winners list will be sent after all winners have been verified.
9. Release: By participating in the promotion and accepting a prize, winners release Sponsor, Released Parties and their agents, partner companies, affiliates, subsidiaries, advertising, promotional, production agencies and judging organizations from any and all liability, loss, harm, and including without limitation, property damage personal injury and/or death which may occur in connection with acceptance and/or use of the prize.
